The Business Improvement Areas Act, passed in 1981, provides the legal foundation for creating BIAs in New Brunswick. Here’s how it works:
Petition and By-Law Creation
A BIA is established when a municipal council passes a by-law in response to a petition from the business community.Formation of a Non-Trading Corporation
A non-trading corporation is formed by the business community to represent the interests of the BIA. Membership includes all businesses and commercial property owners within the BIA’s boundaries.Levy for Funding
The BIA Corporation’s Board of Directors can request the municipal council to impose a levy on all non-residential properties within the BIA. This levy generates funding for the corporation’s activities, such as:Establishing and operating an office
Implementing promotional campaigns
Beautification and improvement projects
Annual Budget Approval
The corporation must submit an annual budget to the municipal council for approval, detailing how the funds will be used before the levy can be imposed.
